Hello, I am Chinese. My boyfriend is American who has never been to China yet. We plan to get married in china in Aug and then stay for two or three years. He runs a self-employed business. I wonder what kind of visa he should get. If he holds a tourist visa, can we get married? Are there any professionals you can refer me to? Thanks.

Dear Brianna,

What state is your fiancée from ?? Is he close to one of the several Chinese Consulates in America ?? If he is near one, such as Los Angeles, New York, San Francisco, Houston, Chicago, etc. he should consult with them as to his specific circumstance. If he is going to do ‘business’ in China, then the Chinese Visa process/status is different than if he was just going to visit with you as a tourist. Without knowing the specifics of his business and his interaction with a company in China, it is more difficult to assess your situation, so I think he should consult with his closest regional Chinese Consulate which serves the state he resides in.

Normally, we Americans, who visit China to be with our loved one, can obtain either a single or a double entry tourist visa, which is good only for a thirty day period for each visa. After the thirty days, you must exit China (even if only to Hong Kong) and then return to start the ‘clock’ on the next 30 day visa.

In your situation, if he wants to do some sort of business in China and remain longer than 30 days after he marries you, then his status may change, based both on the business aspect/needs of his visit, as well as with respect to his actually being married to you, a Chinese national.

As far as him marrying you, his type of visa does not matter. But he must have some documents with him when he arrives in China, if he wishes to marry you at that time. Basically he needs to have proof of eligibility of marriage, from his home state and he will need to have this translated into Chinese, either here in America, or once he arrives in China. Also there are some other local Chinese requirements to fulfill, after he is in China.

Remember, before you can relocate with him to America, when he returns in two to three years, you will have to obtain a spousal visa, from the US Government, because you will already be married. This process, for your American spousal visa takes some time and involves a lot of paperwork, so I suggest [he] start working on it well before his planned return to America.

In this regard, TCG member INMEDIC is currently married to a lovely woman who resides in Shanghai, and is waiting for her US spousal visa to process to conclude. He married her in China, and he has a lot of good information regarding the process. You can wait for his next visit to the forum or write to him at his PM. He may also have some more information about longer term visa’s for your American fiancée ??

Moreover, I would strongly suggest that your fiancée visit any of the various web sites, that address these issues, and educate himself to the entire process, before he visits you in China. Best wishes for your future Brianna !!!
