Who is responsible for her death?

A pregnant woman was sent to a certain hospital in Beijing to give Caesarean birth. However, her husband refused to sign his name in the agreement. Without his consent, the doctors could not give operation to this woman. Finally, this woman and her baby died together. (Supplement:Since August in 2002, the ministry of Health issued a notice that requires the patients to sign an agreement with the hospital if he or she wants to have an operation. If the patient himself/herself could not sign their name, their relatives should sign this agreement instead.)

After the media reported this sad news, many people aired their opinions. Some think that her husband should be sent into prison or sentenced to death. Due to his fault, his wife and baby were dead. For the hospital, they should not be responsible for this accident because they just did as the rule says. Others say that both the husband and the hospital should be responsible for this woman's death. The hospital shouldn't stick to the rule and see this woman dying in front of them. Life is more important than the rule.

What do you think? Who is responsible for this woman's death? I wonder if such things happen in your country. If it happened, what did the hospital do?

The husband was being bull-headed.....

The hospital showed no common sense.

YUP! China is becoming a modern country. :-(

Both are at fault. Even though the hospital tried to stick to the rule, they should have known better. We are talking a life and death situation here. If a person dies, that's it, no more second chances.

Husband is the main culprit and he is to blame although hospital should have some authority to override.

According to the news, the woman's husband was beated badly by his parents-in-law. However, the administration said that the hospital needn't take any responsibility for this woman's death. Some lawyers also had the same opinion with the adminstration. I admit that the hospital had no fault to stick the rule. But how could they see two lives dying in front of them? Didn't they save this pregnant woman first? What a cruel world! I also read another piece of news that said a hospital did not save a person's life because he could not afford the fee. It is sad to see that the hospitals have become commercialized and untilitarian. What is the responsibility of the hospitals? To help those injured people and save their lives. However, some of them have forgotten their responsiblities. Making profits is their real purpose.

On other hand, I can understand why the ministry of Health requires patients to sign an agreement with the hospital. Any operation has risks. In order to avoid the possible dispute between the patient or his/her relatives, the patient or his relatives need to sign this agreement. If the operation fails, the hospital and the doctors could protect their interests.

What do you think of this agreement? I wonder if there is similar agreement in your country.

This I believe is the rule in most countries, in the UK the hospitals will treat a patient no matter if they can pay or not.

I believe the hospital is more culpable than the husband in this case. The husband may have been an uneducated, ignorant and bull-headed man. The hospital has no excuse. It allowed two lives to be lost because of stupid rules.

Well, according to the law, the hospital have no responsibility for this woman's death since they haven't done anything wrong. But from the angle of morality, the hospital is more culpable than the husband as Griz said. They are able to save two lives but they didn't. Shouldn't they be punished or condemned?

Laws made to protect the people or protect the interest of public or society. To maintain better life for the people or society.
Do you think so?

I did not think so. Man made law alway in favor of powerful high ended people, for the administrator to save their interest----.

This is an practical example (Nothing new)
