Hello,

I'm planning to marry my Chinese girlfriend this year and i want her to live with me in the U.K. I was told that to obtain a Fiancee visa is quicker. If she is granted a Fiancee visa, after marriage will the Home Office automatically upgrade it to Sprouse visa once i apply or is there a chance that they might send her back to China after we marry. I ask this question as if this is the case then i would rather marry her in China and then apply for Sprouse visa.

Can anyone advise me on this matter.

Thank you in advance

Whether you get a fiancee visa or not, the UK could still refuse a spouse visa, but it is unlikely. The UK seems to be the easiest country in the world to get foreigners into. In fact, foreigners get treated better than UK citizens! Surely the easiest thing to do is for her to get a tourist visa to the UK. That will give her 6 months in the UK. Then once you are married you can apply for the spouse visa. No need for a fiancee visa unless you want her to stay in the UK for more than 6 months before you marry.

GUESTIAN My wife is Chinese and I get her here in A fiancee visa as the visitor visa was not sucessful. Even then it took 4 visits to the embassy in Beijing. Eventually she was granted a visa but only after I hounded my local MP. Once you are married you will then need to applly for a leave to remain visa which last for 2 years and then ater that an idefinate leave to remain visa. It can be done but is is a very painful exercise

GUEST24170 Don't get your fiance a tourist visa to UK, it's more complicated. because if you are planning to marry her in the UK and she's granted a tourist visa only, the Home office won't grant an extension to stay for her and she will be asked to go back to her country after the marriage then apply for a spouse visa. So the better way is to get her a Fiance visa, marry her in the UK within the 6-month period and then apply for an extension to stay, that's for two years, and then she can apply for Indefinite Leave to Remain (ILR). check this out http://www.globalvisas.com/uk_immigration/fiance_visa.html

goodluck!
