Best way to bring a Chinese woman to the US?
Feb 11, 2008 13:15
guestjudoka I recently went to see my Chinese g/f and realized I am in love with her. First met her when I worked in Shanghai in 2003-2004. Have visited her a few times since I left China. Now I want to marry her and have her live with me in the US. What is the best way?

1. I go to China (has to be on a toursit visa cause I have things going on in the US) and in one month get married with her and get some paper work done before heading back to the US. I figure one month is enough for me to do whatever I have to do in China after the marriage and then she can handle the rest and wait for the green card or whatever it is that needs to be issued for her to move to the US. Is this possible?

Or

2. We get the fiance visa and then marry when she is in the US?

which is the simplest, less costly, and faster way to get this done? Thanks in advance.

Hello "Judoka". I've done some research for you and have found some information from the U.S. Department of State which is directly applicable to you.

The one visa type that comes into question is the Immigrant Visa for a Spouse (IR1 or CR1). Information about this visa type can be found here:

http://travel.state.gov/visa/immigrants/types/types_2991.html

There are two other visa types which you may want to take a look at, namely the Nonimmigrant Visa for a Spouse (K-3) and the Nonimmigrant Visa for a Fiance(e) (K-1) (click the applicable links at http://travel.state.gov/visa/immigrants/types/types_1315.html) but I don't think they apply to you as I'm assuming that you're wanting your future wife to permanently immigrate to the U.S.

You can find out about how much you will be charged for the various services by going to http://travel.state.gov/visa/temp/types/types_1263.html#perm

I hope that helps.

Judoka,

I have around 12 cousins who have married in China. Let me tell you, the process is long and costly either way you go. Half of my cousins did the paperwork on there own and the other half hired lawyers who specialize in this and the time it takes to bring ones spouse over is usually within weeks or months of each other if doing it by yourself or lawyer. Expect at least 2 years after you submit your papers to the USCIS, even longer since they have a larger backlog from the rate increase.

Good Luck Judoka,
Danny
