Hi My small company in California has just set up a factory and office in China. They are going to manufacture and export lighting fixtures/fittings. How easy is it for a small new startup company to qualify to sponsor a new contractor (me) from the United States? Is it easier if they make me an employee? Any tips on this process? Thanks

If the company is funded from overseas you have no problem...except the procedures. You work here on an F visa. This is specifically provided for. If the situation is not quite so clear cut you can work as a consultant contracted by the Chinese company and your pay is paid overseas against an invoice. In practice there are grey areas and most companies would find a way of paying you here. Visa companies can assist if you come across unexpected hurdles

Anyone else have an opinion? I want to get as much info as possible about this? Specifically, are there any hurdles that a newly formed Chinese company - formed with USA money - would have in qualifying to host a US contractor or an employee from the US?
