| Hi, I did marry my wife in Fuzhou and she did arrive in Montreal Canada on December 2009. We are in divorce process since our relation was not like we want it to be but my question is, if i do divorce right now, will she need to go back China? even we divorce i still want her to stay here make her own living. Could any body help plz?? What should i do and what's the rules about divorce without let her go back China. Thank you |

| if I'm right,according to most national laws,a marriage of at least 3 years is aquired, to get a permit to stay. And a moderate knowledge of English. So I think her chances are minimal.Sorry |

| I don't want to sound heartless......but this has all the red flags of a sham (fake) marriage. My brother has been married to his wife for 2 years with a 3 month old baby boy, and its insane how many hoops they still have to jump through with immigration just to prove that they are legit. I don't know how it works in Canada, but if this were the U.S., she would be on the first flight back to China. No ifs ands or buts. Joe |

| First person: No, your wife is not a canadian citizen till 3 years. She will have to go back, but you can help her apply for residency as having someone in Canada speak up for you can help a lot. Second: Go talk tot he Australian authorities. You should have registered the marriage in both countries, you might need to come back to China to get it officially canceled. |

| Gary, Do you divorce just for she told lies when applying for a visa? Why did she tell lies? Divorce is easy. You two make a deal and go to the civil affairs office where you got married. The staff there will handle everything for you. |
