Marrying a Chinese fiance on a Work Visa in the United States

Hello,

My fiance has a student visa which will expire Feb 18, 2011, she is currently working for a company (through optional practical training for 1 year) that will provide her with a work visa, but her student visa will expire before her work visa will arrive, which is in October 2011, the fastest. We are planning to get married at the end of January 2011, is there anyway that she can stay in the US without having to return back to China after we marry when her student visa expires?

Will the few weeks allowed be enough time to complete all the paperwork and approved i.e. Form I-130, etc, for permanent residence? Can she continue to work?

What do I need to do? Very lost. Any help appreciated.

I have finally done some research. But, how long would it take for the I-130 to get approved?

Any help appreciated. Thanks all.

GUEST12911 From the information you provided, you probably refer to form I-485 (green card application).
Depanding on USCIS workload and your place of residence, it varies, but the average is about 8 months.
While her case is pending, she can stay in US "under process". Actually it is better not to go out of the country until her status is determined.
