F Visa = Business/Visit Visa

Hello,

I am interested to know what actual duties i can under go under a Business visa in China. I shall be working for a European company doing a "hands on" engineering project for a Chinese branch of an European company. I will be paid via the European company in my home country and i believe that for anything up to 6 months i can clear my taxes in Europe.

I have had some conflicting information regarding this issue saying that i might have to have a Z visa and a Work Permit to be actually working there. I also need to know that if i am working on a business visa that my insurance will be covered if i have an accident. My job can be quite dangerous and i need to know that i will be covered should there be a problem.

My agent has asked me to work as a sole trader and cover my taxes myself in Europe but i'm not so sure that this is legal.

I guess i'm a little confused but really need the work right now. Any advise would be welcome.

You should have no problem as you are being paid from overseas, tho you might find you cannot stay continuously for the whole period, but must exit and re-enter. Good the employer can pay for a holiday trip home :)

I have met genuine staff in the same situation tho I admit most were not staying for months at the time but spent as long as necessary to get things done. Also many people work here for local employers on an F visa...not strictly within the rules but officialdom is often aware...such is the way of things in China.

Any questions of insurance should be handled by your employer in accordance with the laws of the country you are employed in. Tax is also entirely a matter for your home country: you said that you will be paid at home. I cannot see why your tax situation would change: you are working for a company at home and being sent overseas on project work....but each nation's laws are different. You should not be liable for Chinese tax etc because you are not employed here.
