DUI Arrest '05, No official conviction, must this be disclosed?

guest59201 On the application for the Visa (I'm applying for an L tourist Visa, single entrance) there is the question to indicate Yes/No if you have a criminal record, and then if so to explain further down. Back in 2005 I had a first offense DUI. I plead no contest, and wasn't convicted so to speak as the official record states. For a year I was court supervision/classes/fines to pay and it was done and over with in 2006, thought he arrest is on my record. No legal issues since.

The first time I walked in, I wanted to be honest on the application and put "Yes", briefly explaining the situation on the same application. At the window however, they simply wouldn't take it to be further reviewed or submitted (so I didn't really get an official 'rejection' I believe?) The folks were very difficult to understand behind the glass, and said roughly I 'needed more paperwork' I guess to prove I wasn't on probation or maybe a fugitive? The website and contact information is atrocious. When asking other available consulate staff around they simply were no help.

I'm hoping someone has advice on my next step. Do I go to the courthouse where the incident occurred, get a copy of it, and re-apply with the same application? Or, do I simply select "No" to a prior criminal record as there isn't a Felony or even a conviction dealing with the event on my record...

GUEST13101 Never, ever admit to a criminal record on an application. I've been living in China a few years now. I have two criminal convictions. I always mark "no". stop worrying mark, "no" and forget about it. As long as you are law abiding in China there is no problem

GUEST40102 Really no problem? I heard that to work in China you now need to get fingerprints and a home country criminal background check. Do you know anything about this? Is it different in different cities? Are there ways a round it?

Don't worry, you can just neglect the item and put there with NO if it isn't a felony. If you put YES there, visa officers will surely reject your application.

GUEST36110 Does anyone know if there is way for the chinese government to check your criminal background? Im trying to apply for Z Visa in Guanzhou but Im afraid they will require a no criminal record document. I been convicted of a DUI two months ago.

Hi GUEST36110, for Z visa application, no criminal record document is required. DUI two months ago may be a problem if you apply visa now.
