12 months F visa... part time job possible?
Jun 2, 2012 10:29
guestmaxine Hi all,

I am looking for some information. Have been on a Z visa last year, but quit my job and started working as a consultant. This meant I got a new visa from HK through an agent. Its a 12 months F visa, no max stay, multi entry. I have previously had L visa, then X then Z.

Now I like to know if it is ok for me to receive a salary for some part time work I could do in China. It will be below 4800rmb/month, which I believe is the tax free allowance. However I am not sure I am even allowed to receive any income from a Chinese based company if I am on a F visa.

Could someone please let me know. I do not want to break any rules, or laws. The company says they need my passport and China bank details (I have a bank account here), but I like to know if it will be a problem if I receive a part time salary here.

Any information much appreciated.
Thanks you

GUEST4389 According to related rules, it is not permitted to work as an employee of a Chinese business in China while on an F visa (there are a few exceptions such as working for a company funded from overseas). But many people have done so, often with the full knowledge of local officials. On the other hand, some people have been expelled!

Now you must understand what you should do. By the way, the tax will be imposed on those who earn less than 3500 rmb per month, not 4800 rmb.

GUESTMAXINE Thanks for the reply. Could you please clarify that people earning more (not less!?) than 3500 need to pay tax? I have spoken to several people in the past week, and they all mentioned 4800, so I am a little confused about this.

I assure you that foreigners pay tax when they earn more than CNY 4800. Guest above made a mistake. Chinese national pay tax when then earn more than CNY 3500.

thanks, that is starting to make sense. So if I was to receive a monthly salary of 4800rmb or less I would not need to pay tax, but it would still not be strictly legal, as I am not supposed to work in China on a F visa - is that correct?!

GUEST64234 Correct, you can only work and get paid if you have a Z visa/work/residence permit.
