I'm married to a chinese but cannot get visa in mainland

I'm spanish, I have a business F 6 months visa which expires November the 4th. I just got married with my Yangzhounese girlfriend and we were getting ready to go Yangzhou(her hukou is there) with the marriage certificate and get the visa done there since she is still registered in that area. My gf's father called the person in charge of the foreign affairs and he said "we've never done this kind of visa before and we are concerned that the foreigner could take employment without the proper visa so we can't do it and he needs to go back to his country to apply for the visa".
Now, I'm shocked because as far as I'm concerned I'm not doing anything illegal and I think I have the right to be with my wife. What can I do? Is there any steps to take this to a higher government office? Thanks

GUEST8057 The officer is right. He just says you can't work with F business type one (called M now). If you want to work in PRC, a Z type one is needed. By the way, China is getting harsh on those who vialate the rules and work illegally in PRC after the new entry and exit related rules came into effect in September.

If you just want to stay with your wife, you can apply for the Q1 or Q2 type one for family visit. Q1 enables you stay longer than 3 months in PRC. Q2 just allows you to stay less than 180 days

Sorry, I didn't explained it clearly; the father asked for Q1 visa, I've never intended to work with an F visa, I just want to stay with my wife till our situation is settled and I can find a job which can offer me a working visa. The point is, we asked for a Q1 visa and what papers do we need to bring and they said " he has to do it back in his country, we've never done it here and we don't want to do it cause he might work with the Q1 visa". Now, prior that we asked the shanghai affairs office and they told us I don't need to go back to my country for a Q1. Can they refuse us the right to have a Q1 visa without reason at all?? They don't even know what country I'm from neither look at my passport, directly said that. What can we do?

GUEST92131 Contact a local lawyer who does immigration, at once.
The folks in charge in Yangzhou may be novices in this, but an immigration lawyer may be more fluent, to be able to navigate through all the red tape.
It will cost money, but what is your option?

You needn't go to the foreign affairs office to change your visa from F to Q1. You should go to the local Entry and Exit Mangement Bureau. The officers there decide whether you can change your F to Q1.

I read that some people are required to go back to their own country to apply for the Q1. Different places have different rules. If Shanghai says "Yes", why not go there to try to apply for it?

@wei I've talked to my wife and she said that the name of the place her father called in Chinese is 出入境管理局 which I thought it was the foreign affairs office but in fact is the one you mentioned.
We asked again in Shanghai and Nanjing and both said that I don't need to go back to my country but I need to do it in Yangzhou cause my wife is registered there. Now, Yangzhou is refusing to do it cause they have no experience so we are going to talk to Jiangsu City main exit and entry management bureau to ask them what's going on, any other advise?

GUEST8057 Sorry, I don't have better idea. You might ask them "Why does Shanghai can allow me to apply for the Q1 type without leaving?" I am afraid that they will tell you "If you can do it in Shanghai, then you go there to apply for it. Different places have different rules."

Actually it's impossible to change or convert any kind of visa in china.
You need to go 'abroad', which means your country but also the near hong kong, getting your Q1 visa, then come back to the city of your wife and apply for a 2 years residence permit for family reunion, that you can extend as many times as you need.

My question is: as a holder of family residence permit, if i want to find a job in china what should i do? i heard i don't need the working visa, because i already have a residence permit, but just an employement licence and a foreign expert certificate from the company. is it right?

The best way is to consult the local Entry and Exit Management Bureau in your city. "Heard or being told" might mislead you. The authority will tell you how to do it.
