Employer unwilling to extend work permit and visa

guest14095 I have an employment contract until June of this year.

However, my employer is unwilling/unable to extend my residence permit etc., which is only valid until March.

What is my legal situation, once I don't have a right to stay in China anymore, as may residence permit has run out? Is the employment contract still valid? Can I resign immediately or with 30 days notice? Is my employer required to provide me with recommendation letter and release form in this case?

On a related note, what can I do if my employer cuts/stops paying my salary before or after expiration of my China visa, despite the fact that I still have a contract with them?

GUEST04154 If your employer doesn't help you to renew the residence permit, you have to exit from China before the residence expires. Otherwise, you will overstay your visa and face a fine. I personally think it doesn't matter if you leave without a 30-day prior notice as it's your employer's fault not to extending your residence permit. The recommendation letter and release letter are not necessary if you don't want to continue to work in China.
