Need information about VISA!
Jun 14, 2016 02:48
guest25075 Hi,

My wife and I got married in Hong Kong a month ago. We are both foreigners living in Shenzhen, China. I have a temporary working VISA and residence permit here while she has a student VISA as she completes her studies here. Since we are married, she can get a family visa to stay here with me since her student visa will be expiring soon. However, we will apply for the family visa using her passport that has her family name on it. Next month we are going to her home country and she will get a new passport with my family name on it. My question is, will this cause complications here in china when it comes to the visa renewal, since the family visa will be on her old passport?

GUEST40882 I think it's ok. After she gets a new passport, the residence permit can still be used. But to save troubles, you had better renew her residence permit and transfer it to the new passport, because the name difference may bring you some inconveniences.

When getting a new passport, a letter from the authority normally is given, explaining that the new passport replaces the old one (at least some embassies do that). It is a proof that you can use. By providng the marriage certificate and the official letter, your wife can apply for a family visa.

GUEST31169 Thank you both for your replies. It's very helpful. I'm not sure about the procedure to renew a residence permit while it is still valid (I mean, if she gets the permit right now on her old passport and then gets the new passport 2 months later). Hope it doesn't cause problems!

As for the second solution of obtaining a letter from her embassy back in the home country highlighting the proof of name change, I hope that's a possibility! Will check with the authority there. Thanks for the tip!!

Just one more query: since I'm on a Z visa with a residence permit which I renew once a year through the company I work for, can she apply for a Q1 visa? (I heard that Q2 is a max of 6 months stay, whereas Q1 is longer...) Or would she need to renew the Q2 every 6 months? Also, if she gets offered a job here, can the Q be converted to a Z, provided the company supports any documentation?

Appreciate the help!

GUESTTRACY She cannot apply for Q visa because Q visa is issued to those who are family members of Chinese citizens or of foreigners with Chinese permanent residence and intend to go to China for family reunion. But considering your situation, she should apply for the S visa which includes S1 type visa and S2 type visa. Because she will stay with you, an S1 type is suitable. After getting an S1 type, she is able to get the temporary stay permit. In this case, she can use the residence permit to stay there for a relatively long time.
If she is offered a job there, it's possible for her to change S1 type to a work Z visa in China.

GUEST25075 Thank you for your reply and for the advice. Yea, I misread the visa definitions! S visa it is. Hoping that they grant an S1. My wife's major concern right now is whether they will transfer the proposed S visa from her old passport (current one) to her new one when she applies and gets it from her home country in a couple of months. If the transfer can be done, then no problem (we hope!) Any information if such transfers are possible, given the different surnames on the passports (research has indicated that procuring the document from her embassy proving the name change is horrendously expensive)?
