Replace the word sex with gender, no way laugh or misunderstood.

Gender is the safest way to ask "are you a man or a woman"?.Asking ones gender does not imply any sexual conatations at all. The word "sex" has many diferent meanings and can be confused if the person you are speaking too is not a native English speaker.
So I would not use the word if speaking to a stranger.

in the case of an official form there can be no misunderstanding of the information that they are asking for.
They are not asking you to sleep with them.
But in spoken words it is safer for all IMO when speaking to none native speaking people to avoid using the word Sex.

Then put simply, do not use the word "sex" unless you mean to imply some sort of sex between you and whoever?
It is hard to explain without a very long winded reply. using gender as a term cannot be mistaken as a play between words.

Oh, I am a little bit clear about the subtle distinction between "sex" and "gender". So I will use gender as often as possible instead of sex unless I really mean the physical need. Anyway, thanks for this post and the native-speakers who are so kind to explain the delicate distinction.

As I have the same problem with choosing the correct word to use wnen I try and translate to Chinese and am tying hard not to offend I understand only too well the change of tone in a word or how my message could be understood.

Me too, I have the same problem with choosing the right word between sex and gender.

Well, Dodger, in English language(your mother tongue), the change of tone also causes the change of meaning.
