guest91821 has anyone here ever successfully applied for a Chinese green card after they married a Chinese national? If so could you please tell us about the experience?

There is no real equivalent of the US green card. A tourist visa granted onthe grounds of family reunion is reissued periodically. See Jimmy B's thread yesterday (Ithink), it might help a bit. Permamant residency seems to be reserved for long time friends of China who have invested quite a few millions.

After a certain number of years married to a Chinese national (my girlfriend says it's 5 years), a foreigner can apply for a permanent visa. After 10 years of living in China (whether married or not), a foreigner can apply for Chinese citizenship. Neither of these applications is guaranteed to succeed simply on the basis of 'time served' - these timings are just the minimum thresholds that must be passed before application.

GUEST36162 Actually, there is no regulation that states one can apply for Chinese citizenship after living ten years in China. One can apply immediately upon arrival, but whether it is ten minutes or ten years, chances of approval are, at best, dismal unless one is an overseas Chinese.

As for permanent residence, one can apply based upon marriage to a PRC national after 5 years of marriage and 5 consecutive years of living in China subsequent to marriage and immediately preceding your application for permanent residence. Even meeting the time requirements is no guarantee of approval since most are denied. In order to have any chance of success you need a permanent, stable job and a stable residence.

The Chinese concept of being Chinese is based on race, unlike say Australia or the US which are immigrant countries. So if you are not ethnically Chinese or one of a very small number of very well connected individuals - you have no chance.

GUEST20347 In order to standardize the examination and approval of foreigners' permanent residence in China, these Measures are formulated in accordance with the relevant provisions of the Law of the People's Republic of China on Control of Entry and Exit of Foreigners and the Detailed Rules for its implementation.

Being the spouse of a Chinese citizen or of a foreigner with permanent residence status in China, in a marriage relationship for at least five years, with at least five successive years of residence in China and at least nine months of residence in China each year, and having stable source of subsistence and a dwelling place;
An applicant under Item (5) of the first paragraph of Article 6 herein shall, in addition, submit his (her) Chinese spouse's registered permanent residence certificate or foreign spouse's Foreigner's Permanent Residence Card, marriage certificate, and a notarized certificate of source of subsistence and house leasing certificate or muniments of title. The above-mentioned certificates as issued by a foreign agency shall be subject to the authentication of the Chinese embassy or consulate in the country concerned.

The authorities to accept the applications of foreigners for permanent residence in China are the public security organs of the people's governments of cities with subordinate districts and the public security branch bureaus and county-level bureaus of municipalities directly under the Central Government. The authorities to examine foreigners' applications for permanent residence in China are the departments and bureaus of public security of provinces, autonomous regions and municipalities directly under the Central Government. The authority to examine and approve foreigners' applications for permanent residence in China is the Ministry of Public Security.

How to Get a Green Card in China?

In order to qualify for Green Card holder status, you must fulfill at least one of the following criteria:

I. Be a high-level foreign expert holding a post which promotes China's economic, scientific and technological development, or social progress.

II. Have made outstanding contributions of special importance to China

III. Have made a large direct investment of over US$ 500,000 in China

IV. Have come to China to be with your family, such as spouse, dependent minors or senior citizens.

To apply for the certificate:

I. Submit an application to a city-level Public Security Bureau or at the county-level branch of the Public Security Bureau directly responsible for the community of the applicant's major investment or long-term residence.

II. Provide the specified application documents.

III. The public security body shall investigate and verify the conditions of the
applicant according to the specified pre-requisites.

IV. The local department will submit the application to the Ministry of Public Security for examination and approval.

V. The ministry shall decide whether to approve or reject the application for permanent residence permit within 6 months of receiving the application.

VI. Upon the approval of the Ministry of Public Security, the applicant will be granted a Foreigner Permanent Residency Permit by the Ministry of Public Security.

A Chinese green card is not equivalent to Chinese nationality. Presently China does not recognize dual or multiple nationalities. Thus, if one wants to become a Chinese national, original nationality status would have to be cancelled.

Those who obtain a Chinese green card should not stay in China less than three months in a year or less than a year in five years. Special causes will need approval from city level public security bureaus.

Expats with a Chinese green card will still need to observe rules concerning traveling, temporary living in other cities, and visiting areas closed to the public.

GUEST15583 I also desire a Green Card because I love China, my life, and my family. I have been here for almost eight years now, also married over six years. I am retired now officially and have taken my place as the female head of our family. My husband, a Chinese, has two sons, who graciously care the two of us. I never want to leave China, which is now my home. I simply want to feel like I really belong to a country that I have adopted as my own.
