GUEST11233 One thing that's not clear on this thread, is about the immigration process at the Chinese airports. Is immigration generally a quick face check, stamp of the passport and collect your landing card? is it more of a 5 minute general chat, confirming your plans are consistent with your visa? or is it a forensic examination a la US immigration?

In other words, are you going to get probed about a criminal history on arrival?

Guest11233... It is straight forward. I have entered many, many times but I have never been questioned. The officials usually have stern faces but unless your name/passport triggers an issue you will be thru in 1 minute (after queueing of course)

GUESTTRIPLE ... Hi everyone. I read all 23 pages of this forum, and now I have a question. For the work (Z) visa, do you have to submit a criminal background check if you are applying in the US (or can you just check no)? If so, can you use a state check instead of a federal check?

Also, if you check no and get caught later (in China), what is the penalty?

I have a criminal record in hong kong while on a student visa there. I'm considering just saying 'no' on the application, which everyone seems to recommend, but I'm worries that China and HK share information about this. Anyone know anything about this?

GUESTSCARED ... Hi everyone great thread... I am a Canadian who was caught at the US border and convicted of DRUG USAGE..$500 Fine in 2006, Then I got convicted of DUI in 2007 in Canada aswell as Simple Possesion... I am Currently in the Process of Obtaining my Pardon... In that Time i went to school and am now an Engineer... I am just scared to put NO because i am not sure what will happen in China because they scan the passport, has anyone ever been detained and what could happen... Aswell im thinking maybe i want to say Yes that i have DUI... Ur insight is greatly appreciated...

I have a friend who applied for a business visa and checked yes to the criminal conviction and detailed various convictions relating to the growing of marijuana. He was refused his visa although he had travelled to China previously on a tourist visa, this was after his arrest but before his court hearingo he ticked no for that application.

I have another friend with similar convictions who has ticked no and has been given a tourist visa and more recently a multi entry business visa. He has travelled to and around China without issue.

GUEST93539 Had a DUI in 2005 and applying for a business visa to China. Would this incident bar me from getting a visa if the employer in China is providing business letter and proof of employment, etc? Please advice and should I say yes or no to a criminal record elsewhere as it states on the application? Thx.

GUESTWEED GUEST I am a college graduate looking to teach English overseas. I was recently caught with a small amount of pot, and charged with misdemeanor marijuana possession (less than 20 grams). I go to court tomorrow, where there is a 99% chance I will be given a pretrial diversion program. At the end of the program, my charges will be dropped.

Does anyone have experience with getting a work visa with a pretrial diversion program on their record? Even if I get my record expunged and the charges are dropped, there will still be a record of my arrest and fingerprinting, which rules me out of working in Korea as they do an FBI background check. Kind of ridiculous that "charges dropped" doesn't actually mean that.

GUESTTRVLADV I realize it has been a while since your post, however regarding your question about going into Australia (in case it helps anyone else)....I recommend marking "no". I was there in November. My company had arranged the visa and I was not even aware the question was on the application. They assumed "no" and put it on the application which was approved. I didn't know about that until I arrived. I have travelled all over Europe and S. America and have never seen the conviction question on any immigration forms. I answered "yes" on the immigration form and was almost denied entry. I had to meet with an immigration supervisor and after a long period of questioning she decided to let me in. She said this was 100% at her discretion and that I could have easily been denied by any other customs officer. She also said that they have "the ability" to check backgrounds which leads me to strongly believe that it is not automatic. They probably only check if they have other reasons to suspect something is wrong.

Since the crime was in China, what are the chances of this being flagged?

Also, later, when i get this visa, my company will request for my residency. When they do so, would then this show up?

The reason I worry is because even though I think i should be able to get the VISA, i need this to go smootly because my company doesnt know I have a criminal past, and they gave me only 2 days to be here in HK. In their eyes, i go today, request for rush service, and should have it by tomorrow. If for some reason, it gets flagged and they ask for my information, surely I wont have it by tomorrow, and wont be able to be back to work next Monday. Then i am afraid if either the HK immigration service would contact my company, or if my company starts to ask me question of why I am not back yet.
