GUEST88153 Hi! I am planning to visit China this May (05/23/2012). I am also
getting a student visa to go to a school in China for the 2012-2013
school year. But my school won't be able to complete the compliment
paperwork until the end of July 2012. So here is the problem:


1. When I am in China, after I get the paperwork from school, I was
planning to send the Green Card, Passport, and the school paperwork back
to the States so that my relative can finish it for me, and send to the
Consulate her self. When she is done with it, she will send it back to me.
2. But the problem is. My status in China is still a tourist. I remember
they mark it once when I enter China and once when I leave China (I went
to china once before). If my relative send the Passport, Green Card, and
school paperwork to the Consulate (to apply for student Visa), they will
know that I haven't left China yet. I don't know if this is a problem or
not. It's like having a duplicate Visa.

To put things simple: I am trying to apply for a student visa while I am
already on a tourist Visa. I am a student and trying to save 2000$ going
back to the U.S and to China just because of the Visa.

Is there anything I can do about this?

Yes, it is a problem for you to mail your passport to US without leaving China, once the visa office notices that there is no exit record on your passport, he will know that you still stay in China, it is illegal to mail the passport internationally. You visit China on May 23, 2012, if you are only permitted to stay for 30 days, you can't get all the documents for student visa application. You can go to Hong Kong or Macau to wait for the documents, then apply student visa there, it is very hard to get student visa within Mainland China.

Yes, go to HK or Macau and then send doco back to the US. Use express services throughout and it can be done. I used this approach from the UK, sending my passport to Australia. But be aware, you will not be able to change accommodation in HK and you are technically breaking the law in HK by having no passport. Do at least keep a copy of yr id page in the passport and the entry stamp page. No problem unless some issue arises, the you have 'lost it' ..and sure some hassles follow, but ...!!

I've gone through this thread to try to find out information about work permissions for a student. It seems like students are not allowed to work, and then now students may work with the permission from the school. I've had a looked at the China Scholarship Council site and it stated categorically that students are not allowed to work (!)...so I'm just left confused with the regulations as it doesn't appear to be clear cut.

I'm looking to study Mandarin for 1 year and being able to work PT will make this plan viable. I have considered doing a TESOL course and be qualified as a back up plan but it still cost a bit to get the qualification.

Would appreciate any advice on it!

Students who hold student visa are not allowed to work. This is true.
