Li Kaiqiang: “Definitely not. I would go away as soon as possible.”

Respecting for the old and love for the young is a traditional virtue of Chinese people. However, Li Kaiqiang said that he wouldn’t help the old to stand up if he saw him/her fall on the ground. Why does this young man refuse to help the old to stand up? Let me explain it.

On August 21st, 2008, Li rode his electric bike on his way to his relatives. Suddenly, an old lady who rode a bike hit his bike from the rear. Li turned around and found that an old lady sat on the ground with her bike lay beside her. Li realized that the old lady might get hurt and then tried to help her stand up. When he raised her up, the old lady grabbed him and said “You hit me and my waist got hurt”. Li explained “I am helping you stand up. How could you say I hit you?” However, the old lady still didn’t let him go.

The old lady and Li quarreled and some passers-by stopped to see what happened. A woman with two kids told Li “We all saw what happened. You didn’t hit her. Just go away”. After a while, a patrol man came to them. The old lady told the patrol man that Li drove through a red light and hit her on the waist. The man explained to her that there was no red light. One passer-by reminded Li that the old lady just set him up and that he should go away. However, the old lady called her son to come here. Li also called his father. When the old lady’s son came, he insisted that Li should pay for the medical expenses. Li and his father agreed and accompanied the old lady to the local hospital.

Li and his father both believed that the problem was solved after they sent the old lady to the hospital. But it didn’t go as they wished. In November, the local court sent him a subpoena. Li realized that the old lady sued him to the court. On September 3rd, 2008, the local transportation department issued a report. According to the report, it was the old lady’s fault. However, the local court judged that Li needed to burden 50 percent responsibility and paid around 80 thousand yuan to the old lady because Li couldn’t find a witness to prove that he didn’t hit the old lady.

Currently, Li is looking for those passers-by who witnessed the “accident”. If he failed to find out the witnesses, he would give 80 thousand yuan to the old lady. Luckily, a man has contacted Li and told him that he would be his witness.

Peng Yu, another guy who helped an old lady to stand up at a bus station in Nanjing, was not as lucky as Li Kaiqiang. He sent the old lady to the hospital but the old lady accused him of hitting him when he got off the bus. The Nanjing local court judged that Peng Yu should burden 40 per cent responsibility and pay 45876.36 RMB to the old lady. According to the local court, Peng Yu was guilty for hitting the old lady so that he sent her to the hospital.

People would do anything to get money even in the illicit way. Probably this old lady has health predicament and to treat her health probelm is very costly.

GUEST37242 This is also a problem in western countries..... if you help someone and then they claim you injured them in some way, you are inn a difficult situation. However, I guess this would typically count as a traffic incident and we must call the police unless we are not both unhurt and happy to go our own way. As a result many people now refuse to get involved, though personally I still take the risk.

Not so long back a similar incident occurred to me. and a woman called the police. As a foreigner unable to speak Chinese I was immediately at a disadvantage when the women told a series of lies and induced herself into thetrical tears, it would have done a drama school techer proud. . Ok, the police took us to the police station, all very courteously of course. They provide and paid for a translator and we were able to show there was another side to the story. The police became increasingly sympathetic and it was suggested that an apology from one party and compensation would settle the matter. The compalinant started at 10,000 rmb. I suggested 100 rmb. three hours later with the entire extended family there claiming to know what had happened, and by being very stubborn I got away with paying 300rmb, not exactly the right outcome for helping someone but not a bad one! At no time did the police threated me with being loocked up...and I kept my passport so I didn't panic, I just stood my ground. An interesting experience.

My advice to foreigners is if possible call the police and claim injury and demand to go to hospital, as the complainant you seem to have the addvantage. If you speak Chinese don't admit it, let them supply an intepretor and listen calmly to what is going on, but don't let them find out!~

It happened to my brother before, that is why I used the word "probably" to cushion the impact of of misunderstanding. In the hospital, it was found out she had other health problems. Her friend knocked her down with a bicycle and my brother was only trying to help. Lucky for him, he needed to pay about RMB2000 for her old knee injury.

Maybe you don’t know that there are some professionals who intentionally run into cars to make money.

Look at this guy. He has set up the car drivers many times in the past 9 years. He has earned around 100 thousand yuan in all. Every time he rides his broken bike at the crossroads and seeks opportunities to run into the cars. Once he runs into a car, he falls down on the ground. When the car driver goes out, he requires the car to give him some money. Due to his disability, he even recruits a driver to take him to the crossroads.

A 85-year old man fell on the street but no one went to him to raise him up. He was lying on the ground for 20 minutes. Some people once tried to help him stand up but were stopped by others. Why? They were told “Be ware of being setting up!”.

Honestly speaking, If I was on the scene, I would probably not help him though I felt guilty. I am also afraid of having such a trouble like Li Kaiqiang. Some netizens suggest that we should call the judge who dealt with Peng Yu's case to help these old men who fall on the ground. Is that a good idea?
